Illegal eviction of Muslim families in Jharkhand

PUCL delegation today met Deputy Development Commissioner (DDC) Shri Nagendra Singh on the issue of illegal eviction of erstwhile Khushbu Nagar Muslim families from Khushbubag at Haddi Godaam at Mango, Old Puruliya, Road two days back on the strength of an execution order of the Court with the help of local police.
During the course of discussion it was impressed upon the DDC by the declaration that their appears to be a deep rooted conspiracy into the whole episode as the eviction order mentions Plot No.3588 whereas the area occupied by the Khushbu Nagar people are partly of Plot Nos.3988 and 3653 of Khata No. 1249. The execution order also appears to have mentioned wrong Khata number. Moreover, it appears by the circumstances that both the decree and the eviction order were obtained by the connivance of ‘many concerned’ if not all.
It may be recalled that these Khushbu Nagar Muslim families originally hailing from Andhra Pradesh were settled in G-Town in 1930s. They were subsequently relocated by TISCO at Khusbunagar area of Kasidih in 1940s. As the land was prime land with substantial value, many antisocial elements had an eye on the same for sometime. However, during 1989-90 when the whole country was reeling under communal tension due to Rath Yatra of L.K. Advani the then VHP town President got those Khusbunagar families illegally evicted by force. It should also be noted that few months before the said eviction one Babu of Khusbunagar was killed and bombs were hurled injuring two persons of Khusbunagar by antisocial elements with obvious reasons.
However, against the illegal eviction the members of Insani Ekta Abhiyan a secular front of the city staged a fast unto death dharna in December 1990. Thereafter, as per a tripartite agreement reached among the members of Insani Ekta Abhiyan, some other socio-political organizations, the people of Khusbunagar, and the Administration, it was offered by the District Administration that they be settled at their current place i.e., Khushbubag of Haddi Godaam at Mango, Old Puruliya Road and an administrative building be erected at the disputed land. They were rehabilitated there after due observance of legal formalities. The area was surveyed and the plots were duly verified by land records of the district and found to be freehold land belonging to the State Government.
Now after more than 12 years of that rehabilitation it is pathetic to note that there is an inhuman and illegal attempt to evict them again by the same administration, which rehabilitated them earlier with the help of a seemingly faulty decree and execution order of Court in favour of a local land mafia. PUCL also lamented that inefficient persons of low integrity have manned the administration and the lower judiciary seriously undermining their credibility. However, DDC Nagendra Singh appeared sympathetic to the demands of PUCL delegation and ordered status quo to be maintained and also promised to take restitution initiative after scrutiny of the decree and execution orders of the Court, land records, and other relevant papers.
